General terms and conditions
These General Terms and Conditions (hereinafter referred to as GTC) regulate the relations between the buyer and the merchant, in the area of sales of goods, in particular Silk Flowers, between companies
Julest, sro (hereinafter referred to as "trade") and its business partners (hereinafter referred to as the "Buyer").
I. Basic provisions
These General Terms and Conditions govern the relationship between the buyer and the trader in the sale of goods between Julest, sro and its business partners.
By submitting the order, the Buyer confirms that he has become acquainted with these business terms and conditions, which form an integral part of the Complaint Procedure, and agrees to these Terms and Conditions. These terms and conditions of the buyer are well-informed before the order itself and have the opportunity to get acquainted with it.

The buyer is a consumer or an entrepreneur.
A consumer is a natural person who, when making and executing a contract, is required in the course of his business or other business or in the exercise of his professional activities.
The business-to-consumer is delivering to the seller only his contact information required for trouble-free Ordering or data to be included in the purchase documents.
Legal relationships between buyer and consumer expressly not governed by these GBCs are governed by the relevant provisions of Act. no. 40/1964 Coll., The Civil Code, Act no. 634/1992 Coll., On Consumer Protection, as well as related regulations, all in the wording of the amendments.
- a person registered in the Commercial Register (In particular, a trading company)
- a person who does business on the basis of a trade license (tradesman registered in the trade register)
- a person who does business on a non-business basis under specific rules (for example, they belong to the liberal professions as lawyers, etc.)
- a person who operates agricultural production and is registered in accordance with a specific regulation. Legal relationships of a seller with a buyer who is an entrepreneur explicitly not governed by this GBC or a contract between the seller and the buyer are governed by the relevant provisions of Act no. 513/1991 Coll., The Commercial Code, as amended, as well as the related regulations.
Buyers are aware that buying products that are in the seller's business offer do not create any rights to use the registered trademarks, trade names, company logos or patents of the seller or other companies unless otherwise agreed in a separate agreement.
If the buyer is a consumer, the proposal to conclude a purchase contract is the location of the supplier of the goods on the site, the buyer's contract arises by sending the order to the purchaser by the buyer and accepting the order by the supplier. This acceptable supplier will immediately confirm the buyer with an informative e-mail on the specified email, but this confirmation is not affected by the confirmation. The resulting contract (including the agreed price) may be altered or canceled only by agreement between the parties or for legal reasons. If the buyer is an entrepreneur, an offer to conclude a purchase contract is an order of goods sent to the buyer by the entrepreneur and the purchase contract itself is concluded from the moment of delivery of the buyer's binding consent to the buyer with this proposal.
Relationships and possible disputes arising under the contract will be settled exclusively under the applicable law of the Czech Republic.
The contract is concluded in the Slovak language.
The concluded contract is archived by the seller for its successful performance and is not accessible to third non-participating parties. Information on the individual technical steps leading to the conclusion of the contract is evident from these business conditions where the process is clearly described. Buyer has the option to check and, if necessary, repair before submitting your order. These business terms are displayed on the website of the online store.
The cost of using remote means of communication (telephone, internet, etc.) In order to execute the order, the normal amount depends on the tariff of the telecommunication services used by the buyer.
II. Security and protection of information
The Seller declares that all personal data are confidential, will only be used to perform the performance of the contract with the buyer and will not otherwise be disclosed, provided to a third person, etc., except for a distribution or payment related to the ordered goods (communication of the name and delivery address) . Personal data provided by the buyer to the seller for the purpose of performing the order is collected, processed and stored in accordance with applicable laws of the Czech Republic, 428/2002 Coll. On the Protection of Personal Data, as amended. The Buyer gives the Seller his / her consent to the collection and processing of such personal data for the purposes of fulfilling the subject of the Contract, until such time as it is in writing to disagree with such processing. The buyer has the right to access his or her personal data and the right to repair, including the legal rights to these data.

All prices are contractual. The online eshop is always up-to-date and valid.
The buyer will receive the goods at the price valid at the time of ordering. The buyer has the opportunity to know the price without VAT, before the order, with the total price including VAT and all other charges. This price will be stated in the order and in the receipt confirmation receipt. The buyer has the opportunity to know before the order is made, the amount of time the offer or the price remains valid. In the case of special goods to order or goods that are not in stock, the seller will confirm the buyer in advance by telephone / e-mail the price and the delivery date. If the buyer is a consumer, he must be aware of such goods in advance of the fact that they are custom-made goods with which the conclusion of the purchase contract between the two parties will take place only when the offer is specified by the seller.

VI. Withdrawal from the contract
Withdrawal from the contract by the buyer who is the consumer:
Pursuant to the provisions of Section 12 of the Consumer Protection Act for Selling and Sales by Mail (Act No. 108/2000 Coll.), The buyer has the right to withdraw from the contract thus concluded without giving any reason within 14 working days from the day of taking over of the goods or from the conclusion of the supply contract service, and it is essential that a letter of withdrawal from the contract be delivered to the seller within the specified time.
The buyer also has this right if he has personally picked the goods ordered via the Internet at the seller's place of dispensary.
The goods are forbidden by the buyer to return complete, complete documentation, undamaged, clean, preferably including the original packaging, in the condition and value of the goods. In the event that the goods returned are incomplete or damaged, the seller may reduce the refundable amount by the corresponding amount. The money will be returned to the buyer to the consumer within 15 days of the withdrawal from the buyer's contract.
If the buyer decides to withdraw within this period, we recommend that you deliver the goods to the seller's address along with the enclosed accompanying letter, with the possible reason for withdrawal from the sales contract (not a condition), the purchase receipt number and the bank account number, or indicating whether the amount will be paid in cash or whether it will be drawn for the next purchase.
The buyer notes that if gifts are provided to the goods, the gift agreement between the seller and the buyer is concluded on the condition that if the consumer's right is exercised and the contract is withdrawn pursuant to § 12 of Act no. 108/2000 Z.z., the gift contract shall cease to be effective and the buyer shall be obliged to return the returned goods together with the returned goods.
Upon meeting all of the above conditions for the return of the goods, a credit will be credited to the buyer, which at his / her request will be sent to the account, not later than 15 days after the withdrawal. If the account number is not specified, the amount within the same timeframe is automatically ready for drawdown using a further credit note that is sent to the customer without any unnecessary delay after resolving the withdrawal from the purchase contract.
Withdrawal from the contract by the buyer who is the entrepreneur In the event the buyer is an entrepreneur, the replacement may be offered to the buyer
from the purchase contract depending on the condition of the returned goods, the warranties and actual prices of the returned goods. The condition of the goods is evaluated by the seller. In the event of non-acceptance of conditions acceptable to both parties, the goods will be returned at the seller's expense. The seller is entitled to charge the buyer any additional costs incurred. When a credit note is issued, the buyer may require a Citizen's Card for the purpose
protection of the buyer's ownership rights. By submitting the OP, the buyer agrees to process the personal data according to point II. (within the meaning of Section 3 of Act 428/2002 Coll., on the Protection of Personal Data)
VII. Terms of payment
(a) prepayment by bank transfer
b) on delivery on delivery (the cash is taken over by the customer from the customer)
The goods remain in full payment by the seller's property.
VIII. Terms of Delivery
Shipping by shipping service - SR:
Goods can be sent to the buyer via the Slovak Parcel Service (SPS) or GEIS Parcel.sk. The condition is to send an order and invoice it by 12:00. . The carrier guarantees deliveries to anywhere in the SR within 48 hours. The shipping price is based on the current price list on the day of the order. For orders valued at more than EUR 150, transport is gratis.
Buyer who is an entrepreneur is obligated (buyer who is a consumer is recommended) to immediately check the delivery status of the shipment (parcel number, tape integrity, box damage) along with the carrier, along with the carrier, according to the enclosed shipping note.
The buyer is entitled to refuse to accept a shipment that is not in conformity with the purchase contract, incomplete or damaged. If the damaged item is handed over to the buyer by the transporter, it is necessary to describe the damage in the carrier's delivery protocol.
If the content of the shipment is found to be damaged by the buyer after it has been retrieved, it is necessary within 24 hours to send a written record of damage to the mail to: firstname.lastname@example.org Additional advertising incompleteness or external damage to the consignment does not deprive the consumer of the right to complain but gives the seller the opportunity to prove that this is not a conflict with the purchase contract.
IX. Warranty conditions
The warranty conditions for the goods are governed by the Seller's Complaint Rules and the applicable Czech legislation. As a warranty card It is a purchase receipt.
X. Final Provisions
These General Terms and Conditions are valid from 22.06.2018. The seller reserves the right to change these General Terms and Conditions without prior notice.
